Blizzard taking StarCraft II hackers to court - briefly

In order to protect the real-time strategy hit StarCraft II, developer Blizzard is going beyond just banning hackers. Blizzard has lawyered-up and is preparing to sue three notorious hackers known as 'Permaphrost,' 'Cranix,' and 'Linuxawesome.'
According to the suit, "Just days after the release of Starcraft II, Defendants already had developed, marketed, and distributed to the public a variety of hacks and cheats designed to modify (and in fact destroy) the Starcraft II online game experience. In fact, on the very day that Starcraft II was released, representatives of the hacks Web site advised members of the public that 'our staff is already planning new releases for this game.'"

Blizzard is accusing the trio of multiple counts of copyright infringement, and demanding damages and disgorgement of any profits reaped by the distribution and sale of the hacks. The company also accuse the defendants of inducing others to infringe on their copyright, saying, "When users of the Hacks download, install, and use the Hacks, they copy StarCraft II copyrighted content into their computer's RAM in excess of the scope of their limited license, as set forth in the EULA and ToU, and create derivative works of StarCraft II."

"The harm to Blizzard from Defendants' conduct is immediate, massive and irreparable," the suit claims. "By distributing the Hacks to the public, Defendants cause serious harm to the value of StarCraft II. Among other things, Defendants irreparably harm the ability of Blizzard's legitimate customers (i.e. those who purchase and use unmodified games) to enjoy and participate in the competitive online experience. That, in turn, causes users to grow dissatisfied with the game, lose interest in the game, and communicate that dissatisfaction, thereby resulting in lost sales of the game or 'add-on' packs and expansions thereto."

The three defendants named in the suit go by the handles "Permaphrost," "Cranix," and "Linuxawesome," with the former two residing in Canada and the latter in Peru. It's unclear what jurisdiction the court has over the accused, although Starcraft II's end-user license agreement specifically states that disputes would be decided by a court within Los Angeles County. Additionally, among the relief demanded by the developer is a requirement that the defendants pull their programs hosted anywhere within the court's jurisdiction. There are other allged hackers named in the suit--including "Wiggley," "Zynastor," and "Dark Mage," but Blizzard has not included their real identities in the suit.

The only thing these useless hackers and pirates deserve is a life behind bars. These types of people should have there rights to own anything resembling a PC taken away from them period. There criminals and they need to be monitored on a daily basis like any other criminal.

While I think what blizzard is doing is right, I also think that putting someone behind bars for this is kind of silly. It doesn't truly do irreparable harm to the game. Every new patch breaks the hacks. The hackers could just give the source code to blizzard and they could patch it up.

The likelyhood of anyone quitting the game over a few other people hacking is totally BS(Provided that blizzard continually goes to ban cheaters regularly). Hackers will eventually stop, people quitting over hackers? Not likely.

I don't think it's silly in the least. It costs the company plenty of money in support to fix what they break and to block what they could potentially break (part of why each patch breaks hacks). Then these asses are profitting off of their losses? IMO and experience, there are a lot of people who quit or pass up on games that harvest cheaters. I don't see the point of a EULA if you will just let people blatantly do what they want. Take a look at a lot of the FPS on PC. What a disaster.

Don't try and act smart gx-x there is absolutely no copyright that disallows you drawing Disney characters. There is however a copyright barring you from profiting from drawing Disney characters.

I wasn't trying to make a point regarding that exact "news" quote, but point in general about "intellectual" rights, eulas etc.

Did those who cheated in single player SC2 make profit? No. But still they were "just" banned. I guess they were lucky for not being sued and dragged to court in Los Angeles and asked to pay tribute, sorry, I meant penalties, penalties for ruining the intended gameplay experience, thus creating damages to blizzard :D

If blizzard is trying to scare people away from their products - they are doing one heck of a job. I am impressed by all their "by the power of the Greyskull (EULA) - I have the power!" actions, really, I am.
