I've been higly considering gathering as many gamers from Canada as possible and launch a class action lawsuit against various software makers who are continuing to infringe on our rights as a Canadians.
In Canada I am allowed a personal backup of software/music/video, irregardless of whatever protective measures a company or entity puts in. As such I have lost many CD's because of scratches, because my child has been able to acquire the sources that were put away or just from continual use. The result has been several hundreds of dollars lost because of over-exagerative means to secure their software. These game companies are not only circumventing my right but they have gone out of their way to install hidden device drivers 'without' my consent and without advertising these intentions on the box or in a license agreement, this same exagerative practice has caused me to lose data because of 'forced' and unacknowledged reboots of my PC due to the fact the protective drivers believe I am doing something to infringe their securities eg. Starforce. The laws may differ in other countries but in Canada this is our right. I am allowed a personal backup with the idea that I do not distribute this software. I believe these companies should not only compensate me for my losses but also provide me and other Canadians with a means to backup our software.
As from our Software copyright laws.
(The owner of an authorized and legitimate copy of a piece of software may reproduce a single copy of the software, for backup purposes, provided that the single backup copy is destroyed immediately once the person ceases to be the owner of the authorized copy of the software).
The same applies for music and video purchases.

Techinicaly you could still make a backup, but it won't be 1:1 copy.
What i also think is that publishers and developers are loosing more customers than winning pirates. |
